Geoff - yes, this is an artifact from the Open command "opening"
a new file & marker 1 situation. This only happens with the Open command
with marker index 1. (I must have taken "Open" too literally the other
day when tweaking up the multiple marker code in this initial beta
release of 1.3.) I'll patch this fairly soon. I'll wait a few days and see
if anyone reports any other bugs I don't know about.

The work around for now would be:

1) Issue a Next file, Prev file, or Gate file command instead
of Open once marker 1 is defined (Use the List to collect all
the file names for Next & Prev).

or,

2) Use marker index 2 or higher if you want to keep them around
when using the Open command.

or,

3) Copy the markers to the marker clipboard first, then issue
a Paste from the marker dialog to get them back after
using the Open command.
